City of Portland faces lawsuit over denied permit to remove dangerous tree before it fell

A lawsuit filed Friday in Multnomah County Circuit Court names the City of Portland and Jennifer Cairo, the city forester for Portland, and seeks over $4.7 million in damages.
The lawsuit was filed by Sarah and Joel Bond, who bought a home at Southwest 41st Avenue and Fairvale Drive in April 2021.
According to court documents, the Bonds contacted Oregon Tree Care a month after buying the home because they were concerned a Douglas Fir was leaning and could fall on one of the upstairs bedrooms.
The arborist told them that despite the danger, the city was unlikely to let them remove the tree.
In January 2022, Joel Bond submitted an application to remove two trees, saying they were dangerous.
After a winter storm in 2024, the tree fell on the couple’s house.
