CLOVERDALE, Ore. (KATU) – A teacher has been on administrative leave with the Nestucca Valley School District since the spring when he was charged with allegedly sexually abusing a minor female student in his classroom.
According to court documents, 46-year-old Brian Anthony Hoogendijk was arraigned on May 9 on eight counts of third-degree sex abuse (Class-A misdemenor). Court documents note the charges are related to incidents alleged to have occurred between Sept. 1, 2019, and April 2024.
A quarterly report published by the Oregon Department of Human Services about founded allegations of abuse in Oregon schools.
The report noted that the date of the incident is unknown but says it was reported to DHS on April 18, 2024.
A motion filed in court by Hoogendijk’s lawyer on Sept, 23 alleges that the Nestucca Valley School District conducted their own "internal" investigation into allegations the same student made against Hoogendijk on Oct. 27, 2023.
“An investigation regarding (the alleged victim) and Mr. Hoogendijk was launched by the Nestucca School District and closed the same day. As a result of the investigation, Mr. Hoogendijk requested surveillance camera be installed in his classroom,” the motion reads in part.
The motion does not detail the nature of the alleged internal investigation nor whether it is related to the charges Hoogendijk is facing. When asked, DHS would not say if it had received any reports regarding Hoogendijk prior to April 18. The Tillamook County Sheriff’s Office (TCSO) also would not give a date of when it had first received information about the alleged abuse.
Oregon law prohibits schools and districts from conducting internal investigations into child abuse allegations. All school teachers, staff, and administrators are required by law to report suspicions of child abuse to DHS and law enforcement. While those allegations are being investigated, schools are required to place the teacher on administrative leave.
The TCSO said it arrested Hoogendijk on May 8 and charged him with second-degree sex abuse, a Class-C felony. The county’s district attorney would not answer questions about the case and why prosecutors ultimately decided to go with a third-degree charge instead.
"Upon receiving information from the Nestucca School District regarding a report of possible sex abuse between a teacher and student, TCSO Detectives responded and interviewed the student victim and student witnesses. There were no further victims identified at that time," a spokesperson for TCSO said in a written statement.
